AN ACT concerning

Workmen's Compensation - Uninsured Employers' Fund

FOR the purpose of authorizing the Uninsured Employers' Fund to
appear at hearings, raise issues and file discovery
proceedings in workmen's compensation cases.

BY repealing and reenacting, with amendments,

Article 101 - Workmen's Compensation
Section 90(c) and 95
Annotated Code of Maryland
(1985 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 101 - Workmen's Compensation

(c) If the employer does not notify the Commission of his
objection as provided in subsection (b) and does not make payment
of the award, the claimant may apply to the Director of the
Uninsured Employers' Fund Board for payment from the Fund. THE
FUND MAY PAY THE AWARD OR APPLY FOR REVIEW UNDER THE PROVISIONS
OF § 95 OF THIS ARTICLE.

95.

The provisions of this article with respect to procedure and
the right to appeal to the courts shall be reserved to the
claimant, and to the uninsured employer, and to the Fund. THE
FUND'S RIGHT OF REVIEW INCLUDES THE RAISING OF ISSUES, DISCOVERY,
AND A HEARING BEFORE THE COMMISSION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
