certificate.
(3) Birth certificate information may not be given if
it is to be commercial solicitation or private gain.
(c) (1) Except as otherwise provided by law, the Department
shall collect a $2 fee for each certified or abridged copy of a
birth, death, fetal death, or marriage certificate or for a
report that a search of the files was made and the requested
record is not on file.
(2) The Department may not collect a fee for a
certificate requested by an agency of this State or any of its
political subdivisions.
(3) The Secretary may waive all or part of a fee if
chargeable to an agency of the United States.
(D) THE SECRETARY SHALL INCLUDE WITH EVERY COPY OF A DEATH
CERTIFICATE, IN A FORM PRESCRIBED AND PROVIDED BY THE INSURANCE
COMMISSIONER, A NOTICE WHICH ADVISES THAT CERTAIN INDIVIDUALS MAY
BE ENTITLED TO CONTINUATION OF GROUP HEALTH INSURANCE BENEFITS
UNDER ARTICLE 48A, § 490G OF THE CODE.

(D) HEALTH MAINTENANCE ORGANIZATIONS SHALL PROVIDE
CONTINUATION COVERAGE REQUIRED UNDER ARTICLE 48A, § 490G OF THE
CODE.

(A) A LICENSED FUNERAL DIRECTOR, PRIOR TO FINAL DISPOSITION
OF THE BODY, SHALL PROVIDE TO THE SURVIVING SPOUSE OR IMMEDIATE
FAMILY MEMBERS OF THE DECEASED OR AUTHORIZED REPRESENTATIVE A
NOTICE WHICH ADVISES THAT CERTAIN INDIVIDUALS MAY BE ENTITLED TO
CONTINUATION OF GROUP HEALTH INSURANCE BENEFITS UNDER ARTICLE
48A, § 490G OF THE CODE.
(B) THE NOTICES REQUIRED TO BE PROVIDED IN SUBSECTION (A)
OF THIS SECTION SHALL BE SUPPLIED TO THE LICENSED FUNERAL
DIRECTOR BY THE INSURANCE COMMISSIONER.
(C) A LICENSED FUNERAL DIRECTOR WHO FAILS TO PROVIDE NOTICE
UNDER SUBSECTION (A) OF THIS SECTION SHALL NOT BE LIABLE TO ANY
PERSON FOR BENEFITS WHICH WOULD HAVE OTHERWISE BEEN PAYABLE UNDER
ARTICLE 48A, § 490 OF THE CODE OR OTHER DAMAGES RESULTING FROM
THE FAILURE TO PROVIDE NOTICE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
apply to group contracts issued or renewed after the effective
date of this Act.
