County and currently paid to the Prince George's County Committee
of the Maryland Historical Trust would be paid instead to Prince
George's Heritage, Inc. Prince George's Heritage, Inc. is a
private nonprofit corporation that has been approved by the
Maryland Historical Trust in accordance with the Attorney
General's advice that County Committees should establish
nonprofit corporations to receive funds. During the final week
of the Session, Senate Bill 919 was amended to require that the
portion of the marriage ceremony fee imposed in Cecil County that
is currently paid to the Cecil County Committee of the Maryland
Historical Trust be paid instead to Cecil Historical Trust, Inc.
The amendment would also require all funds collected by the Cecil
County Committee prior to July 1, 1986 to be transferred to Cecil
Historical Trust, Inc.
The Attorney General's Office has advised me that Senate
Bill 919, as amended, is inconsistent with House Bill 1043 that
was signed into law on April 8, 1986. House Bill 1043 was
supported by the Cecil County Delegation to the General Assembly
and would continue the current requirement that a portion of the
marriage ceremony fee imposed in Cecil County be paid to the
Cecil County Committee of the Maryland Historical Trust. If
Senate Bill 919 were signed into law, that payment would shift
from the county committee to Cecil Historical Trust, Inc.
The Chairman of the Board of Trustees of the Maryland
Historical Trust has requested a veto of Senate Bill 919 because
the Cecil Historical Trust, Inc. has not been approved by the
Maryland Historical Trust as a nonprofit corporation to receive
County Committee funds. In addition, it is not necessary to
establish an independent nonprofit corporation in Cecil County
this year. The deadline for County Committees to establish
nonprofit corporations is July 1, 1987 which allows time during
the 1987 Session to consider any necessary additional
legislation.
The sponsor of Senate Bill 919 does not object to my veto of
this legislation because the companion House Bill 1682, which I
have signed today, accomplishes the same purpose as Senate Bill
919 with respect to Prince George's County, but does not contain
the amendment that would shift funds in Cecil County.
Therefore, for the above reasons, I have decided to veto
Senate Bill 919.
