AN ACT concerning
Juvenile Causes - Jurisdiction of the Court -
Contributing to the Delinquency of a Child
FOR the purpose of altering the jurisdiction of the juvenile
court and the District Court so that they have concurrent
jurisdiction in proceedings against an adult for
contributing to, encouraging, causing, or tending to cause
any act, omission, or condition by a child which results in
a violation or which renders the child delinquent
delinquent, in need of supervision, or in need of
assistance.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Courts and Judicial Proceedings
3-804.
(c) The court has [exclusive original] CONCURRENT
jurisdiction WITH THE DISTRICT COURT over proceedings against an
adult for the violation of § 3-831 of this subtitle. [However,
the court may waive its jurisdiction under this subsection upon
its own motion or upon the motion of any party to the proceeding,
if charges against the adult arising from the same incident are
pending in the criminal court. Upon motion by either the State's
Attorney or the adult charged under § 3-831, the court shall
waive its jurisdiction, and the adult shall be tried in the
criminal court according to the usual criminal procedure.]

(b) (1) Except as provided in § 4-303 of this subtitle AND
PARAGRAPH (2) OF THIS SUBSECTION, the District Court does not
have criminal jurisdiction to try a case in which a juvenile
court has exclusive original jurisdiction.
(2) THE DISTRICT COURT HAS CONCURRENT JURISDICTION
WITH THE JUVENILE COURT OVER PROCEEDINGS AGAINST AN ADULT FOR ANY
VIOLATION OF § 3-831 OF THIS ARTICLE.
