AN ACT concerning

Tri-County Council of Western Maryland

FOR the purpose of establishing the Tri-County Council of Western
Maryland as an association of local governments and as a
regional planning and development agency for the tri-county
area of Allegany, Garrett, and Washington counties;
providing for the status, dissolution, jurisdiction,
intergovernmental relations, and legal advisor of the
Council; providing that the Council may not be placed in one
of the principal departments of State government; providing
for certain bylaws and for the membership, chairman,
director, staff, terms, and compensation of the Council;
providing for the powers, duties, and functions of the
Council; establishing the budget and financing of the
Council; requiring the Council to provide for a general
development plan according to certain objectives;
establishing procedures for the adoption of the general
development plan; providing for the membership, terms, and
compensation of the board; providing for the powers and
duties of the board; and generally relating to the
Tri-County Council of Western Maryland.

Preamble

WHEREAS, Article 78A, § 13B of the Code is the legislative
authorization for participation by the State of Maryland in the
Appalachian Regional Development Program and authorizes the
certification of a local development commission; and

WHEREAS, The Tri-County Council of Western Maryland is an
out-growth of the Governor's Council for Western Maryland which
was created by Executive Order on May 25, 1968 to provide
guidance and direction for the Appalachian Regional Program; and

WHEREAS, Articles of incorporation for the Tri-County
Council were approved in 1971 chartering the agency to serve
Allegany, Garrett, and Washington counties; and

WHEREAS, There is an increased need for the Tri-County
Council to be an effective and positive force for the resolution
of regional problems by the concerted action of the
