MAY PERMIT RECREATIONAL OPPORTUNITIES, INCLUDING ACCESS TO THE
CHESAPEAKE BAY AND ITS TRIBUTARIES:
(1) WHERE FEASIBLE; AND
(2) WHERE THE RECREATION WILL NOT ADVERSELY AFFECT
THE NATURAL STATE OF THE LAND.

APPROPRIATIONS FOR THE HERITAGE CONSERVATION FUND MAY BE
PROVIDED FROM:
(1) SURPLUS PROCEEDS GENERATED BY § 13-209 OF THE
STATE FINANCE AND PROCUREMENT ARTICLE;
(2) SPECIAL BOND AUTHORIZATION;
(3) (2) GENERAL FUNDS OF THE STATE; AND
(4) (3) OTHER SOURCES.

THE BOARD OF PUBLIC WORKS SHALL APPROVE EACH ACQUISITION OF
A CONSERVATION EASEMENT OR A FEE SIMPLE OR OTHER INTEREST IN
PROPERTY PROPOSED BY THE DEPARTMENT UNDER THIS SUBTITLE.

NOTWITHSTANDING ANY OTHER PROVISION OF THE CODE, AFTER JUNE
30, 1986, THE DEPARTMENT MAY NOT USE ANY FUNDS, WHETHER UNDER THE
HERITAGE CONSERVATION FUND, PROGRAM OPEN SPACE, OR OTHERWISE, TO
ACQUIRE LAND IN GARRETT COUNTY. THIS SECTION DOES NOT PROHIBIT
THE DEPARTMENT FROM USING ANY FUNDS TO EXCHANGE LAND IN GARRETT
COUNTY, AS LONG AS THE TOTAL ACREAGE DOES NOT EXCEED THAT AMOUNT
OWNED BY THE DEPARTMENT ON JUNE 30, 1986.
Article - Tax - Property
13-209.
(a) The revenue from transfer tax is payable to the
Comptroller for deposit in a special fund.
(b)(1) The special fund under subsection (a) of this
section:
(i) is used to pay principal and interest on
the bonds issued under the Outdoor Recreation Land Loan of 1969;
and
(ii) subject to paragraph (2) of this
subsection, the balance of the revenue, not required under
paragraph (1)(i) of this subsection, shall be allocated.
