Ch. 840

DECLARE VOID the [contract note] SUBCONTRACT and shall be liable
only for the reasonable value of the [services] WORK performed
and materials [supplied] PROVIDED.

(e) Any person, [whether] INCLUDING an employee[,] OR
prospective employee [or not] with information concerning
violations of [the requirements of] this section OR OF A
NONDISCRIMINATION CLAUSE, may inform the Board OF PUBLIC WORKS
which shall cause an immediate investigation TO BE MADE of the
charges. If the Board OF PUBLIC WORKS concludes that the charges
are true it [shall] MAY invoke [the] ANY remedies [set out in
this section] AVAILABLE BY LAW.

[Subtitle 9. Fraud.] PART VI. COLLUSION FOR PURPOSES
OF DEFRAUDING THE STATE.

[13-901.] 11-210. FRAUD.

(a)  A person who [enters into a contract with the State
after engaging] ENGAGES in collusion with another person IN
CONNECTION WITH THE PROCUREMENT PROCESS for the purpose of
defrauding the State, is liable in a suit brought by the Attorney
General in the appropriate court for damages equal to three times
the value of the loss to the State [which] THAT is attributable
to the collusion.

(b)  If [there is a reasonable basis for believing] A
PROCUREMENT OFFICER HAS REASON TO BELIEVE that collusion has
occurred [among any persons for any reason, the procurement
officer] IN CONNECTION WITH THE PROCUREMENT PROCESS THE
PROCUREMENT OFFICER shall send a written notice of [this] THE
PROCUREMENT OFFICER'S belief AND THE BASIS FOR THE BELIEF to the
[Office of the Attorney General] STATE LAW DEPARTMENT.

(c)   [All documents involved in any procurement in which
there is a reasonable basis for believing that collusion has
occurred shall be retained by the procurement agency until the
Office of the Attorney General] IF THERE IS REASON TO BELIEVE
THAT COLLUSION HAS OCCURRED IN CONNECTION WITH THE PROCUREMENT
PROCESS, ALL RELEVANT DOCUMENTS SHALL BE RETAINED UNTIL THE STATE
LAW DEPARTMENT gives notice that they may be destroyed. These
documents shall be made available to the [Attorney General] STATE
LAW DEPARTMENT immediately on request.

PART VII. DEBARMENT OF CONTRACTORS FOR
OFFENSES OTHER THAN BRIBERY.

11-211. DEBARMENT FOR OFFENSES OTHER THAN BRIBERY.

(A) FOR THE PURPOSES OF THIS SECTION THE FOLLOWING WORDS
HAVE THE MEANINGS INDICATED.

(1) "BUSINESS" MEANS ANY CORPORATION, PARTNERSHIP,
INDIVIDUAL, SOLE PROPRIETORSHIP, JOINT VENTURE, OR OTHER LEGAL
ENTITY THROUGH WHICH COMMERCIAL ACTIVITY IS CONDUCTED.
