(a)  This [subtitle] PART XIV may be cited as the Maryland
Procurement of Architectural and Engineering Services Act —
Transportation Agencies.

(b)  This [subtitle] PART XIV and the Maryland Procurement
of Architectural and Engineering Services Act — General Using
Authorities may be cited jointly as the Maryland Architectural
and Engineering Services Act.

[Subtitle 2.] PART XV. General Using Authorities --

[Architectural-Engineering Services. ]

PROCUREMENT OF ARCHITECTURAL SERVICES AND ENGINEERING SERVICES.

[19-201.] 11-167. DEFINITIONS.

(a) In this [subtitle] PART XV the following words have the
meanings indicated.

[(b) "Contract" means any using authority contract for
architectural or engineering services, except contracts for
construction inspection services which shall not be covered by
this subtitle and shall not be under the jurisdiction of the
General Selection Board, provided that such services have been
obtained in accordance with the appropriate competitive bidding
processes in Title 13 of this Division II of this article.]

(B) "ARCHITECTURAL AND ENGINEERING SERVICES" MEANS
ARCHITECTURAL SERVICES, ENGINEERING SERVICES, OR BOTH.

[(c) "Department" means the Department of General
Services.]

[(d)] (C) "Person" includes:

(1)   [An] AN individual, receiver, trustee, guardian,
executor, administrator, fiduciary, or representative of any kind
and any partnership, firm, association, public or private
corporation, or other entity; and

(2)   [Unless] UNLESS the context requires otherwise,
this State, any county, municipal corporation, or other political
subdivision of this State, and any of their agencies or units.

[(e) "Secretary" means the Secretary of General Services.]

[(f)] (D) "Using authority" means any [using] STATE agency,
as defined in § [ll-101(s) of this Division II] ll-l0l(JJ) of
this article, other than the Department of Transportation, its
units, or the Maryland Transportation Authority.

[19-202.] 11-168. GENERAL SELECTION BOARD ESTABLISHED.

There is a General Professional Services Selection Board in
the Department OF GENERAL SERVICES, referred to in this
[subtitle] PART XV as the General Selection Board.
