the procurement but [may not be less than] SHALL BE GIVEN AT
LEAST 10 days [prior to the date for the] BEFORE BID opening [of
bids].
[(2) Notices of invitations for bids on State
contracts for which the bid amount is reasonably expected to be
over $25,000 and notices of the subsequent awards of those
projects shall be published in the Maryland Register.
(3) A notice of invitation for bids required under
paragraph (2) shall be published at least 30 days before the bid
opening date. Publication of the notice required by paragraph
(2) which is less than 30 days before the bid opening date shall
be defective notice, unless the project is exempt from
competitive sealed bidding by State law.]
(III) IF BID PRICES ARE REASONABLY EXPECTED TO
EXCEED $50,000 $25,000. OR A LOWER THRESHOLD AMOUNT SET BY THE
BOARD BY REGULATION, NOTICE OF THE INVITATION FOR BIDS SHALL BE
PUBLISHED IN THE MARYLAND REGISTER AT LEAST 15 20 DAYS BEFORE BID
OPENING. THIS SUBPARAGRAPH DOES NOT APPLY TO A PROCUREMENT IF
THE RESULTING CONTRACT IS REASONABLY EXPECTED TO BE PERFORMED
ENTIRELY OUTSIDE THIS STATE AND THE DISTRICT OF COLUMBIA.
(IV) NOTICE OF EACH AWARD OF A CONTRACT UNDER
THIS SECTION SHALL BE PUBLISHED IN THE MARYLAND REGISTER.
[(4) Notices of awards of contracts exempt from the
bid notice publication requirement of paragraph (3) shall be
published in the Maryland Register.]
[(5) In the event of an emergency, the head of the
procurement agency may waive the requirements of this section.
The necessity for the waiver shall be documented and published in
the Maryland Register.]
[(6)] (V) Notices of [invitation] INVITATIONS for
bids [on other State contracts and their subsequent awards] NOT
REQUIRED TO BE PUBLISHED IN THE MARYLAND REGISTER may be
published in the Maryland Register [at the option of the State
documents administrator when requested by the procurement agency,
and when publication is considered in the State's interest by the
procurement agency and the State documents administrator] IN
ACCORDANCE WITH SUBTITLE 2 OF TITLE 7 OF THE STATE GOVERNMENT
ARTICLE OF THE CODE.
[(7) Public notice may also be given by publication
in a newspaper of general circulation in this State or in any
other publication which will give adequate public notice.]
(VI) PUBLIC NOTICE OF AN INVITATION FOR BIDS
MAY ALSO BE GIVEN BY POSTING ON A BID BOARD AND BY PUBLICATION IN
NEWSPAPERS, PERIODICALS, AND TRADE JOURNALS.
