(7)  Conditions, including emergencies, and procedures
under which procurement may be made by means other than
competitive sealed bidding;

(8)  Rejection of bids and offers, consideration of
alternate bids, and waiver of informalities in bids and offers;

(9)  Safeguarding confidential, proprietary
information, and trade secrets submitted by actual or prospective
bidders and offerors;

(10)  Partial, progressive, and multiple awards;

(11)  Definitions and classes of contractual services
and procedures for acquiring them;

(12)  Reports;

(13)  Procedures for advertisement and public notice
of solicitations;

(14)  Review of contracts into which the department
has entered, for the purpose of evaluating the procurement
process to determine whether the process results in obtaining
supplies, services, or construction of the quality desired, and
whether they were procured at reasonable prices on the most
favorable terms; and

(15)  Conditions and procedures under which
procurement of human, cultural, social or educational services
may be made by methods of source selection other than as provided
in Title 13 of this article.

(d) The Board or a department may adopt any other
regulations, consistent with this Division II of this article, it
may consider advisable to carry out the purposes of this Division
II of this article.]

11-105. STATE PROCUREMENT ORGANIZATION.

(A)  THIS SECTION DOES NOT APPLY TO CAPITAL EXPENDITURES BY
THE DEPARTMENT OF TRANSPORTATION AND THE MARYLAND TRANSPORTATION
AUTHORITY, IN CONNECTION WITH ROADS, BRIDGES, AND HIGHWAYS, AS
PROVIDED IN § 11-206 OF THIS ARTICLE, WHICH EXEMPTS THESE
EXPENDITURES FROM BOARD REVIEW. HOWEVER, ALL OTHER SECTIONS OF
THIS ARTICLE APPLY.

(B)  (1) (I) THE BOARD HAS AUTHORITY TO CONTROL ALL
PROCUREMENT BY STATE AGENCIES.

(II) TO IMPLEMENT THE PROVISIONS OF THIS

SUBTITLE DIVISION II, THE BOARD MAY SET POLICY AND ADOPT

REGULATIONS AND INTERNAL OPERATIONAL PROCEDURES CONSISTENT WITH
THIS SUBTITLE DIVISION II.
