this subtitle, OR A VIOLATION OF § 14-12B-07 OF THIS SUBTITLE, is
an unfair or deceptive trade practice WITHIN THE MEANING OF
COMMERCIAL LAW ARTICLE, TITLE 13 UNDER TITLE 13 OF THE COMMERCIAL
LAW ARTICLE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.

AN ACT concerning
Consumer Protection - Health Club Services
FOR the purpose of imposing certain registration and renewal fees
on each person who sells health club services in this State;
requiring a person who sells health club services to
purchase a certain surety bond; requiring a person who sells
health club services agreements to maintain certain records;
authorizing the Consumer Protection Division of the Office
of the Attorney General to inspect certain records under
certain circumstances; authorizing the Division to revoke
the registration of a person who fails to maintain or
produce certain records under certain circumstances;
requiring a person who sells health club services at a
facility under construction to maintain a certain surety
bond; requiring the Division to made certain information
available to the public in a specific manner; creating a
health club administration fund for certain purposes;
altering the manner in which a buyer of health club services
may cancel an agreement for health club services permitting
a buyer of health club services for a facility that is not
in existence when the contract is executed to rescind the
contract and have deposits refunded within a certain time if
the constructed facility does not provide services
substantially as promised in the agreement; requiring a
seller of health club services to disclose certain
information to the buyer regarding the buyer's right to
cancel an agreement; requiring a seller to disclose certain
information to the Consumer Protection Division of the
Office of the Attorney General at a certain time;
authorizing the Division to issue a cease and desist order
under certain circumstances; making each sale of health club
services agreements that violates this Act, and a violation
of a provision requiring the seller of health club services
to disclose certain information to the Division at a certain
time, an unfair or deceptive trade practice; defining a
