AN ACT concerning

Montgomery County and Prince George's Counties -

Planning and Zoning Powers

PG/MC 21-86

FOR the purpose of authorizing the County Council of Montgomery
County and the County Council of Prince George's County, by
legislation, to impose standards and requirements to control
the subdivision and development of land in areas with
inadequate public facilities; specifying the manner of
exercise of such powers; and generally relating to the
powers of Montgomery County and Prince George's Counties in
regard to planning, zoning, and land development.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

IN ADDITION TO ANY OTHER AUTHORITY GRANTED BY THIS ARTICLE,
THE COUNTY COUNCIL OF MONTGOMERY COUNTY AND THE COUNTY COUNCIL OF
PRINCE GEORGE'S COUNTY, BY LEGISLATION, MAY IMPOSE IN THEIR
RESPECTIVE COUNTY STANDARDS AND REQUIREMENTS, AT ANY TIME PRIOR
TO THE ISSUANCE OF A BUILDING PERMIT, FOR THE PURPOSE OF AVOIDING
THE SCATTERED OR PREMATURE SUBDIVISION OR DEVELOPMENT OF LAND
BECAUSE OF THE INADEQUACY OF TRANSPORTATION, WATER, SEWERAGE,
DRAINAGE, SCHOOL, OR OTHER PUBLIC FACILITIES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
