[(iii)] 3. dedicated for the use of all the
residents without payment of fee or admission.
(2) THE AMOUNT OF A PROPERTY TAX CREDIT GRANTED UNDER
PARAGRAPH (1)(I)4. OF THIS SUBSECTION MAY NOT EXCEED 25% OF THE
COUNTY PROPERTY TAX OR THE MUNICIPAL CORPORATION PROPERTY TAX DUE
ON THE PROPERTY.
(3) THE GOVERNING BODY OF MONTGOMERY COUNTY OR OF THE
MUNICIPAL CORPORATION SHALL SPECIFY THE QUALIFICATIONS FOR
ELIGIBILITY AND CONDITIONS OF CERTIFICATION FOR THE TAX CREDIT
UNDER PARAGRAPH (1)(I)4. OF THIS SUBSECTION.
(4) ON APPLICATION OF THE GOVERNING BODY OF A
MUNICIPAL CORPORATION AND APPROVAL BY THE GOVERNING BODY OF
MONTGOMERY COUNTY, THE PROPERTY ELIGIBLE FOR A CREDIT AGAINST THE
MUNICIPAL CORPORATION PROPERTY TAX, UNDER THIS PARAGRAPH, SHALL
ALSO RECEIVE A CREDIT AGAINST THE COUNTY PROPERTY TAX.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.

AN ACT concerning
Washington Suburban Sanitary Commission - Erosion and
Sediment Control Regulations

FOR the purpose of allowing the Washington Suburban Sanitary
Commission (WSSC) to provide for civil penalties and fines
for violations of the Erosion and Sediment Control
Regulations of the WSSC; providing for issuance delivery and
payment of citations for violations; providing that these
violations are civil offenses instead of criminal
misdemeanors; providing for payment of certain fines to
WSSC; establishing certain fines; defining certain terms;
providing for District Court jurisdiction to adjudicate
violations of the Erosion and Sediment Control Regulations
of WSSC; allowing certain violators of these regulations to
have their case decided by the District Court; providing a
schedule of certain fines; and generally relating to the
imposition of civil monetary fines and penalties for
violations of the WSSC Erosion and Sediment Control
Regulations.
