CHAPTER 65

(House Bill 810)

AN ACT concerning

Family Law - Joint Custody of Children

FOR the purpose of permitting a court to award sole custody of a
minor child to either parent or joint custody to both
parents; and generally relating to joint custody of
children.

BY repealing and reenacting, with amendments,

Article - Family Law

Section 5-203(c)

Annotated Code of Maryland

(1984 Volume and 1985 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Family Law

5-203.

(c) (1) If the parents live apart, a court may award
custody of a minor child to either parent OR JOINT CUSTODY TO
BOTH PARENTS.

(2) Neither parent is presumed to have any right to
custody that is superior to the right of the other parent.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.

CHAPTER 66

(House Bill 830)

AN ACT concerning

Frederick County - State's Attorney's Salary

FOR the purpose of altering the salary of the State's Attorney
for Frederick County; and providing that this Act does not
affect the incumbent.
