government or of this State or any other securities acceptable to
the Department. The amount of the cash deposit or the market
value of any securities shall be at least equal to the required
sum of the bond. The local governing body shall receive and hold
any such cash or securities in the name of the appropriate
subdivision, in trust, for the purposes for which the deposit is
posted. The obligation of the applicant and of any corporate
surety under the bond shall become due and payable, and all or
any part of any cash or securities shall be applied to payment of
the costs of properly closing [and covering] a [landfill]
SOLID WASTE ACCEPTANCE FACILITY, INCINERATOR, OR TRANSFER STATION
only if the Department has:

(1)  Notified the applicant and any corporate surety

that the [landfill] SOLID WASTE ACCEPTANCE FACILITY,

INCINERATOR, OR TRANSFER STATION has not been closed [or covered]
In a manner that prevents erosion, health and safety hazards,
nuisances, and pollution, specifying in the notice the particular
deficiencies in the closing [or covering] of the [landfill]
SOLID WASTE ACCEPTANCE FACILITY, INCINERATOR, OR TRANSFER STATION
to be corrected;

(2)  Given the applicant and any corporate surety a
reasonable opportunity to correct the deficiencies and to close
[and cover] the [landfill] SOLID WASTE ACCEPTANCE FACILITY,
INCINERATOR, OR TRANSFER STATION in accordance with the standards
adopted by the Department; and

(3)  Authorized the local governing body to close [and

cover] the [landfill] SOLID WASTE ACCEPTANCE FACILITY,

INCINERATOR, OR TRANSFER STATION properly in accordance with the
standards adopted by the Department.

(D) THE SECRETARY MAY, BY REGULATION, EXEMPT ANY FACILITY
PERFORMING LEGITIMATE RECYCLING OR RECLAMATION FROM THE
REQUIREMENTS OF THIS SECTION SUBSECTION.

9-210.

(a) Whenever the Secretary finds that the water or ice from
any public or private source of water or ice supply is or is
likely to become dangerous to health, or that the discharge of
sewerage or the method of disposal of sewage or [refuse] SOLID
WASTE, from any system, FACILITY, or plant, public or private, is
or is likely to become prejudicial to health or comfort, the
Secretary shall order that the source of water or ice supply be
closed, or that the point of sewage discharge, or method of
disposal of sewage or [refuse] SOLID WASTE, be abandoned.

(c) If a public or private system of water supply,

sewerage, or [refuse] SOLID WASTE disposal is condemned by the
Secretary, the Secretary may order such arrangements made by the
owner of said system or plant as will effectually prevent its
operation.
