(d) This title does not limit the right of an individual to
provide nonmedical nutritional information or to distribute
nutritional literature.

Subtitle 2. State Board of Dietetic AND NUTRITION Practice

4.5-201.

There is a State Board of Dietetic AND NUTRITION Practice in
the Department.

4.5-202.

(a)  (1) The Board consists of 7 members.

(2)  Of the 7 Board members:

(i) 5 shall be dietitians OR NUTRITIONISTS
licensed on or after July 1, 1986 to practice dietetics in
Maryland, including:

1.  One member who is engaged primarily in
clinical dietetic practice;

2.  One member who is engaged primarily in
community or public health dietetic practice;

3.  One member who is engaged primarily in
administrative dietetic practice;

4.  One member who is engaged primarily in
consulting dietetic practice; and

5.  One member who is a faculty member in
the field of dietetics or nutritional science; and

(ii) 2 shall be consumer members.

(3)  The Governor shall appoint the dietitian AND
LICENSED NUTRITIONIST members with the advice of the Secretary
and with the advice and consent of the Senate from a list of 10
dietitians AND LICENSED NUTRITIONISTS submitted jointly by the
Maryland Dietetic Association and [faculty] THE PRESIDENTS of the
Maryland institutions of higher education which graduate dietetic
practitioners.

(b)  (1) Each dietitian OR LICENSED NUTRITIONIST member of
the Board shall:

(i) Be a citizen of the United States;

(ii) Be a resident of the State;

(iii) Have practiced dietetics for at least 5
of the last 10 years.
