AN ACT concerning
Procurement - Exemption - Mental Retardation and
Developmental Disabilities Administration
FOR the purpose of extending the exemption for the acquisition of
human, social, cultural, and educational services by the
Mental Retardation and Developmental Disabilities
Administration from the State Procurement Law; and generally
relating to exemptions from the State Procurement Law.
BY repealing and reenacting, with amendments,
Chapter 399 of the Acts of the General Assembly of 1985

Preamble
WHEREAS, It is the policy of the State to promote continuity
and quality of care as well as cost effectiveness in the
procurement of human, cultural, social, and educational services;
and
WHEREAS, The Mental Retardation and Developmental
Disabilities Administration is in the process of implementing a
reasonable cost reimbursement method for purchasing community
based services for mentally retarded and nonretarded
developmentally disabled individuals; and
WHEREAS, Chapter 399 of the Acts of the General Assembly of
Maryland of 1985 provides that the acquisition of human,
cultural, social, and educational services is not subject to the
provisions of the State Procurement Law until June 30, 1986; and
WHEREAS, The Mental Retardation and Developmental
Disabilities Administration's implementation of its prospective
payment system is scheduled to begin July 1, 1986; and
WHEREAS, During the current fiscal year, 1986, the Mental
Retardation Developmental Disabilities Administration has not
developed a demonstration project to evaluate the prospective
payment system in order to make necessary modifications prior to
full implementation of the system on July 1, 1986; now,
therefore,
