SECTION 2. AND BE IT FURTHER ENACTED, That this Act is
hereby declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety and having
been passed by a yea and nay vote supported by three-fifths of
all the members elected to each of the two Houses of the General
Assembly the same shall take effect from the date of its
passage.
SECTION 2. AND BE IT FURTHER ENACTED, That the reduction in
revenues resulting from the maximum surcharge imposed under this
Act shall not be offset by increases in surcharge rates to any
electric consumer subject to the environmental surcharge imposed
under § 54B of Article 78 of the Annotated Code, nor shall it be
deemed a cost of generation or an allowable expense for
rate-making purposes under § 54B of Article 78 of the Annotated
Code.
SECTION 3. AND BE IT FURTHER ENACTED, That the Department
of Natural Resources after consultation with the Public Service
Commission shall study the need for continued monitoring and
research with respect to the existing and proposed electric power
plants in Maryland, the degree to which the activities of the
Power Plant Siting and Research Program are consistent with the
statute, the definable overall level of funding after 1990, and
the appropriate source of funding, including but not limited to,
the existing environmental surcharge, alternative taxes on power
generation, and State general funds, and report, not later than
May 1, 1987, to the Legislative Policy Committee with
recommendations including draft legislation for funding the
necessary monitoring and research program.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall
take effect June 1, 1986.
