(II) THE UNIT REFUSES TO PROPOSE THE REGULATION
ANEW UNDER SUBSECTION (A) OF THIS SECTION.

(2) IF THE ADMINISTRATOR REFUSES TO PUBLISH A NOTICE
OF ADOPTION BY A UNIT UNDER THIS SUBSECTION, THE ADMINISTRATOR
SHALL:

(I) NOTIFY THE UNIT AND THE COMMITTEE OF THE
REFUSAL; AND

(II) REQUEST THE COMMITTEE TO CONSIDER WHETHER

THE COMMITTEE CHOOSES TO OPPOSE ADOPTION OF THE AMENDED

REGULATION UNDER § 10-111.1 OF THIS SUBTITLE.

(3) IF THE COMMITTEE CHOOSES NOT TO OPPOSE ADOPTION
OF THE REGULATION, THE ADMINISTRATOR SHALL PERMIT PUBLICATION OF
THE NOTICE OF ADOPTION OF THE REGULATION.

(C) (1) IF THE UNIT INTENDS TO MAKE A CHANGE TO A PROPOSAL
AT THE TIME OF ADOPTION, THE ASSISTANT ATTORNEY GENERAL REVIEWING
THE REGULATIONS IN ACCORDANCE WITH § 10-107 OF THIS ARTICLE SHALL
DESCRIBE IN WRITING WHY EACH CHANGE IS NOT SUBSTANTIVE AND NEED
NOT BE PROPOSED ANEW UNDER SUBSECTION (A) OF THIS SECTION THE
ADMINISTRATOR SHALL REFUSE TO PUBLISH THE NOTICE Of ADOPTION OF A
REGULATION THAT DIFFERS FROM THE TEXT PREVIOUSLY PUBLISHED UNLESS
THE NOTICE IS ACCOMPANIED BY A CERTIFICATION FROM THE ATTORNEY
GENERAL THAT THE PROVISIONS OF SUBSECTIONS (A) AND (B) OF THIS
SECTION ARE NOT APPLICABLE.

(2) THE WRITTEN DESCRIPTION CERTIFICATION SHALL;

(I) BE PREPARED IN THE FORM AND ACCORDING TO
GUIDELINES SPECIFIED BY THE ADMINISTRATOR;

(II) CONTAIN A DESCRIPTION OF THE NATURE OF
EACH CHANGE AND THE BASIS FOR THE CONCLUSION: AND

(II) (III) BE PUBLISHED IN THE REGISTER AS PART
OF THE NOTICE OF ADOPTION; AND

(III) INCLUDE THE NAME OF THE ASSISTANT

ATTORNEY GENERAL MAKING THE DETERMINATION.

SECTION 2. AND BE IT FURTHER ENACTED, That if any provision
of this Act or the application thereof to any person or
circumstance is held invalid for any reason, the invalidity shall
not affect the other provisions or any other application of this
Act which can be given effect without the invalid provisions or
application, and to this end all the provisions of this Act are
declared to be severable.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
