AN ACT concerning

Laboratory Tissue Banks - Medical and Technical Directors

FOR the purpose of providing that a tissue bank employ or
contract with both a technical director and medical
director; establishing the qualifications of the technical
director and medical director; providing that the technical
and medical director may be the same person under certain
circumstances; and generally relating to the regulation of
laboratory tissue banks.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

17-303.

(a)  The Secretary shall adopt rules and regulations that
set qualifications for directors of tissue banks.

(b)  The rules and regulations shall require [the director
of a tissue bank in this State to be a physician licensed to
practice medicine in this State] THAT A TISSUE BANK IN THIS STATE
EMPLOY OR RETAIN UNDER CONTRACT:

(1)  A TECHNICAL DIRECTOR, QUALIFIED BY TRAINING AND
EXPERIENCE FOR THE SCOPE OF ACTIVITIES BEING PURSUED, WHO WILL
OVERSEE AND BE RESPONSIBLE FOR ALL TECHNICAL ASPECTS OF THE
TISSUE BANK'S OPERATIONS; AND

(2)  A MEDICAL DIRECTOR. WHO WILL BE A PHYSICIAN
LICENSED TO PRACTICE MEDICINE IN THIS STATE AND WHO WILL BE
RESPONSIBLE FOR ALL MEDICAL ASPECTS OF THE TISSUE BANK'S
OPERATIONS, UNLESS THE TECHNICAL DIRECTOR QUALIFIES AS A MEDICAL
DIRECTOR UNDER THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.
