(1) A final judgment in any amount;
(2) A settlement in any amount; OR
(3) A final disposition not resulting in payment on
behalf of the insured. Reports shall be filed no later than
March 15th of the year following the occurrence of (1), (2) or
(3) above.
(b) The reports required by subsection (a) OF THIS SECTION
shall contain:
(1) The name and address of the insured;
(2) The insured's policy number;
(3) Date of occurrence which created the claim;
(4) Date of suit if filed;
(5) Date and amount of judgment or settlement, if
any;
(6) Date and reason for final disposition if no
judgment or settlement;
(7) A summary of the occurrence which created the
claim; AND
(8) [And such] SUCH other information as may be
required.
(c) Reports relating to practitioners of medicine shall be
filed with the Commission on Medical Discipline, and reports
relating to hospitals, nurses, dentists, [osteopaths,]
podiatrists, optometrists, OR chiropractors[, or blood banks]
shall be filed with the [Commissioner of Insurance] APPROPRIATE
LICENSING BOARD FOR THESE HEALTH CARE PROVIDERS.
(d) The reports filed in accordance with this section shall
be treated as confidential records. The reports shall be
released only for bona fide research or educational purposes.
Reports relating to physicians may be released to the State Board
of Medical Examiners; reports relating to hospitals [and blood
banks] may be released to the Department of Health and Mental
Hygiene; and reports relating to nurses, dentists, [doctors of
osteopathy,] podiatrists, optometrists, and chiropractors may be
released to the appropriate licensing board for such health
providers. The recipient of the report in its sole discretion
shall determine the validity of any request for the reports.
(e) There shall be no liability on the part of and no cause
of action of any nature shall arise against any insurer reporting
hereunder or its agents or employees, or the Commission or its
representatives, or [the Commissioner of Insurance or his
|
