IMPLEMENT THE MINIMUM LIVABILITY CODE. THE SECRETARY MAY WAIVE
THE MATCHING REQUIREMENT IN CIRCUMSTANCES WHERE ADEQUATE LOCAL
RESOURCES ARE NOT AVAILABLE
.

(2) THE MATCHING GRANTS SHALL BE ALLOCATED USING A
FORMULA TO BE DEVELOPED BY THE SECRETARY TAKING INTO ACCOUNT
POPULATION AND OTHER RELEVANT FACTORS.

(3) A POLITICAL SUBDIVISION MAY CHARGE A PROPERTY
OWNER AN INSPECTION FEE FOR ANY INSPECTION IN CONNECTION WITH
ENFORCEMENT OF THE MINIMUM LIVABILITY CODE.

(E)  (1) ANY PERSON PROPERTY OWNER WHO WILLFULLY VIOLATES
ANY PROVISION OF THE HOUSING LIVABILITY CODE ADOPTED UNDER
SUBSECTION (A) OF THIS SECTION IS GUILTY OF A MISDEMEANOR AND ON
CONVICTION FOR EACH VIOLATION IS SUBJECT TO A FINE NOT EXCEEDING
$500 FOR EACH DAY THAT THE VIOLATION EXISTS OR IMPRISONMENT NOT
EXCEEDING 3 MONTHS, OR BOTH.

(2) ANY PENALTY ORDERED UNDER PARAGRAPH (1) OF THIS
SUBSECTION IS IN ADDITION TO AND IS NOT A SUBSTITUTE FOR ANY
OTHER PENALTY AUTHORIZED UNDER A FEDERAL, STATE, OR LOCAL LAW.

(F) A PERSON MAY NOT BE DISPLACED BY ENFORCEMENT OF THE
MINIMUM LIVABILITY CODE UNLESS ALTERNATE HOUSING IS PROVIDED.

SECTION 3. AND BE IT FURTHER ENACTED, That from July 1,
1986 through September 1, 1986, the Department shall conduct
public hearings throughout the State on the livability code, and
on November 1, 1986, the Department shall publish the livability
code as proposed regulation in the Maryland Register. From
November 1, 1986 through February 15, 1987, the proposed
livability code shall be reviewed by the Joint Committee on
Administrative, Executive, and Legislative Review and the
standing fiscal committees, and by no later than April 1, 1987,
the Department shall adopt the livability code in the final form
in the Maryland Register.

SECTION 4. AND BE IT FURTHER ENACTED, That from April 1,
1987, through July 1, 1988 January 1, 1989, the livability code
will not be binding but will serve as a model tor local
governments to consider for local adoption.

SECTION 5. AND BE IT FURTHER ENACTED, That on July 1, 1988
January 1, 1989, the livability code shall become law and shall
become binding on any local government that has not adopted its
own livability code as specified in Section 4 of this Act.

SECTION 3 6. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1986.
