Control Fund and to the separate account created by § 7-220(b) of
the Health - Environmental Article of the Code, and to be
expended for:

(a)  All costs incurred by the State for removal,
restoration, or remedial action, including the restoration of
natural resources where feasible, in response to a release or
threatened release of any controlled hazardous substance, to the
extent the costs are not reimbursable under the Comprehensive
Environmental Response, Compensation, and Liability Act of 1980;
and

(b)  The State share mandated under § 104(c)(3) of the
Comprehensive Environmental Response, Compensation, and Liability
Act of 1980.

(4) An annual State tax is imposed on all assessable
property in the State in rate and amount sufficient to pay the
principal of and interest on the bonds, as and when due and until
paid in full. The principal shall be discharged within 15 years
after the date of issue of the bonds.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect June 1, 1986.

AN ACT concerning

Oyster Shells - Returning to Chesapeake Bay

FOR the purpose of requiring a commercial oyster packer to

reserve oyster shells for the Department of Natural

Resources for certain purposes, providing exceptions to this
Act; providing that oyster packers do not have to comply
with this Act due to certain budgetary constraints of the
Department, requiring the Department to determine a fair
market value for fresh oyster shells in a certain manner;
prohibiting a person from selling oyster shells for any

purpose that is contrary to this Act; requiring the

Department to conduct a study to explore techniques to
insure the most efficient utilization of fresh oyster shells
obtained from Maryland packers; providing that the study
shall determine what are fresh oyster shells requiring the
Department of Natural Resources to establish develop a

certain program to encourage the return of oyster shell to
the waters of the State; authorizing the use of certain
