(B) HOWEVER, ANY "SENDING" AND "RECEIVING" AREAS MUST BE
LOCATED SOLELY WITHIN THE BOUNDARIES OF THE COUNTY ENACTING THE
REGULATIONS OR WITHIN THE BOUNDARIES OF A MUNICIPALITY WITHIN THE
COUNTY.
(C) IF A MUNICIPALITY ELECTS TO ENACT TRANSFER OF
DEVELOPMENT RIGHTS REGULATIONS, "SENDING" AND "RECEIVING" AREAS
MAY BE:
(1) WITHIN THE BOUNDARIES OF THE MUNICIPALITY; OR
(2) WITHIN THE BOUNDARIES OF THE COUNTY IN WHICH THE
MUNICIPALITY IS LOCATED.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect Jane July 1, 1986.

AN ACT concerning
Natural Resources - Ocean Beach Replenishment
FOR the purpose of preserving and improving Maryland's barrier
island beaches by establishing a certain special fund for
ocean beach protection and replenishment"; authorizing use of
the fund directly or through loans or grants to local
government for certain beach replenishment and protection
projects, subject to certain restrictions; describing
certain eligible project costs; providing certain
limitations on the amount of State assistance for certain
types of projects; requiring that all projects will be State
designed and managed; establishing that any land created in
connection with a project will be titled to the State and
may not be patented; requiring local project sponsors to
provide certain guarantees, including certain financing
arrangements for the local share of project costs; providing
that certain State funds may be withheld from a local
government in the event that the local government failed to
pay its share of project costs; establishing certain factors
for valuation of land to be acquired by the State in
connection with an ocean beach replenishment project; and
generally relating to establishing a program for
replenishment of the State's ocean beaches.
