AN ACT concerning

Registered Nurses - Penalty for Misrepresentation

and Prohibited Acts

FOR the purpose of altering the penalty against a person who

represents falsely that the person is authorized to practice
registered for the false representation of being a nurse or
for performing certain prohibited acts in the practice of
nursing.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That the Laws of Maryland read as follows:

Article - Health Occupations
7-710.

(A) EXCEPT FOR A VIOLATION OF § 7-707 OF THIS SUBTITLE, A
PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING
$5,000 OR IMPRISONMENT NOT EXCEEDING 1 YEAR OR BOTH.

(A) [A} EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS

SECTION, (B) A person who violates any provision of § 7-707 OF
this subtitle is guilty of a misdemeanor and on conviction is
subject:

(1)  For a first offense, to a fine not exceeding
$100; and

(2)  For any subsequent violation of the same
provision, to a fine not exceeding $500 or imprisonment not
exceeding 6 months or both.

(B) A PERSON WHO REPRESENTS TO THE PUBLIC IN VIOLATION OF §
7-703(A)(1), (B), OR (C) OF THIS SUBTITLE THAT THE PERSON IS

AUTHORIZED TO PRACTICE REGISTERED NURSING IS GUILTY OF A

MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING
$1,000 OR IMPRISONMENT NOT EXCEEDING 1 YEAR OR BOTH.
