(ii) A Type II school vehicle, as defined in
this subtitle,

(b) "School vehicle" does not include a privately owned
vehicle while it is carrying members of its owner's household and
not operated for compensation.

21-706.

(a)  If a school vehicle is stopping or has stopped on a
roadway and is operating the alternately flashing warning lights
specified in § 22-228 of this article, the driver of any other
vehicle meeting or overtaking the school vehicle:

(1)  Shall stop [10] AT LEAST 20 feet from the rear of
the school vehicle, if approaching the school vehicle from its
rear, or [10] AT LEAST 20 feet from the front of the school
vehicle, if approaching the school vehicle from its front; and

(2)  May not proceed until the school vehicle resumes
motion or the alternately flashing warning lights are
deactivated.

(b)  This section does not apply to the driver of a vehicle:

(1)  In Baltimore City;

(2)  In an incorporated city or town that, according
to the most recent federal decennial census, has a population of
more than 100,000 people; or

(3)  On a divided highway, if the school vehicle is on
a different roadway.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall

take effect July 1, 1986.

drawer under certain conditions; providing for a certain
