(House Bill 220)
AN ACT concerning

Employee Disclosure and Confidentiality Protection -

Filing of Complaints

FOR the purpose of requiring that complaints filed under the

State employee disclosure and confidentiality protection law
be made within a certain period of time.

BY repealing and reenacting, with amendments,

Article 64A - Merit System
Section 12H(b)

Annotated Code of Maryland

(1983 Replacement Volume and 1985 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That the Laws of Maryland read as follows:

Article 64A - Merit System.

12H.

(b) An employee or applicant for employment may charge an
appointing authority with a violation of § 12G of this subtitle
in a complaint filed with the Secretary of Personnel. The
Secretary shall notify the appointing authority of the complaint
and shall provide an opportunity for the authority to respond to

the complaint in writing. A COMPLAINT MUST BE FILED WITH THE

SECRETARY WITHIN 100 DAYS FROM THE DATE OF THE OCCURRENCE ALLEGED
TO BE A VIOLATION OF THIS SUBTITLE. A COMPLAINT ALLEGING A

VIOLATION OF THIS SUBTITLE SHALL BE FILED WITH THE SECRETARY
WITHIN 1 YEAR AFTER THE DATE THE EMPLOYEE FIRST KNEW, OR SHOULD
HAVE KNOWN, OF THE VIOLATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall

take effect July 1, 1986.
