AN ACT concerning

Appropriation or Use of State Waters
Applications for State Waterway Construction Permits -

Waiver of Certain Public Hearing Requirements

FOR the purpose of providing that the Department of Natural

Resources may waive certain public hearing requirements for
water appropriation or use waterway construction permit
applications on certain roads, bridges, and culverts that
meet certain design standards and do not result in adverse
impacts, on certain utility projects that meet certain
design standards and certain construction conditions, and on
certain clearing and grading projects that do not exceed
certain limits of disturbance; and requiring the Department
of Natural Resources to supply certain information to
interested persons.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That the Laws of Maryland read as follows:

8-806.

(d) The Department may waive holding a public hearing on
any permit application under the following conditions:

(1) If there is an emergency or a request to make
minor repairs, the Department, upon written or oral application,
may grant an application to repair any reservoir, dam, or
waterway obstruction without notice or hearing. Repair necessary
to save life or property may be made without an application, but
notice shall be given promptly to the Department.
