authorized by this subsection in lieu of the payment authorized
by subsection (a), may receive a fixed payment in an amount equal
to the average annual net earnings of the business or farm
operation, except that the payment may not be less than [$2,500]
$4,440 nor more than [$10,000] $17,760 $20,000 UNLESS ADJUSTED

UNDER PARAGRAPH (3) OF THIS SUBSECTION.

(3)(I) EFFECTIVE JANUARY 1 OF EACH YEAR, A PUBLIC OR

PRIVATE AGENCY SHALL ADJUST THE MINIMUM AND MAXIMUM PAYMENT
LIMITS SET FORTH IN PARAGRAPH (2) OF THIS SUBSECTION TO REFLECT

ANNUAL CHANGES IN THE RATE OF INFLATION OR DEFLATION AS INDICATED

BY GROWTH IN PROPRIETORS' INCOME STATISTICS PREPARED BY THE
BUREAU OF ECONOMIC ANALYSIS IN THE DEPARTMENT OF COMMERCE AS A

COMPONENT IN THE BUREAU'S PERSONAL INCOME SERIES.

(II) THE ADJUSTMENTS IN THE MINIMUM AND MAXIMUM
PAYMENT LIMITS SET FORTH IN PARAGRAPH (2) OF THIS SUBSECTION
SHALL BE ROUNDED OFF TO THE NEAREST $10.

(III) THE BASE FOR THE ADJUSTMENTS UNDER THIS
PARAGRAPH SHALL BE THE AMOUNTS SPECIFIED IN PARAGRAPH (2) OF THIS
SUBSECTION FOR CALENDAR YEAR 1984.

(4) (3) In the case of a business, no payment may be
made under this subsection unless the public or private agency is

satisfied that the business (i) cannot be relocated without a

substantial loss of its existing patronage, and (ii) is not a

part of a commercial enterprise having at least one other

establishment not being acquired by the public or private agency

which is engaged in the same or similar business.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.

FOR the purpose of authorizing the Comptroller, or any authorized

officer or employee of the Comptroller, to disclose certain
taxpayer identity information to private contractors for the
purpose of obtaining telephone numbers for certain purposes;
prohibiting private contractors from using or disclosing
certain taxpayer identity information received from the
Comptroller; and generally relating to the use and
