CHAPTER 406

(House Bill 17)

AN ACT concerning

Witnesses - Loss of Employment

FOR the purpose of prohibiting an employer from depriving an

employee of the employee's job solely because of job time
lost as a result of the employee's response to a subpoena to
appear as a witness at certain proceedings; and providing a
penalty for a violation of this Act.

Article - Courts and Judicial Proceedings

Section 9-205

Annotated Code of Maryland

(1984 Replacement Volume and 1985 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

9-205.

(A) AN EMPLOYER MAY NOT DEPRIVE AN EMPLOYEE OF THE
EMPLOYEE'S JOB SOLELY BECAUSE OF JOB TIME LOST BY THE EMPLOYEE AS
A RESULT OF THE EMPLOYEE'S RESPONSE TO A SUBPOENA REQUIRING THE
EMPLOYEE TO APPEAR AS A WITNESS IN ANY CIVIL OR CRIMINAL
PROCEEDING, INCLUDING DISCOVERY PROCEEDINGS.

(B) AN EMPLOYER WHO VIOLATES THIS SECTION IS SUBJECT TO A
FINE NOT EXCEEDING $1,000.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall

take effect July 1, 1986.
