(2) EACH DAY A VIOLATION OCCURS CONSTITUTES A

SEPARATE VIOLATION.

(C)(1) AT THE REQUEST OF THE COMMISSION THE COURT MAY
ISSUE AN ORDER TO CEASE AND DESIST FROM ANY VIOLATION OF THIS
ARTICLE AND MAY VOID AN OFFICIAL ACTION TAKEN BY AN OFFICIAL OR
EMPLOYEE WITH A CONFLICT OF INTEREST PROHIBITED BY THIS ARTICLE
IF:

(I) THE ACTION AROSE FROM OR CONCERNED THE
SUBJECT MATTER OF THE CONFLICT;

(II) THE LEGAL ACTION WAS BROUGHT WITHIN 90
DAYS OF THE OCCURRENCE OF THE OFFICIAL ACTION; AND

(III) THE COURT DEEMS VOIDING THE ACTION TO BE
IN THE BEST INTEREST OF THE PUBLIC.

(2) THE COURT MAY NOT VOID ANY OFFICIAL ACTION UNDER
THIS SUBSECTION APPROPRIATING PUBLIC FUNDS, LEVYING TAXES, OR

PROVIDING FOR THE ISSUANCE OF BONDS, NOTES, OR OTHER EVIDENCES OF
PUBLIC OBLIGATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall

take effect July 1, 1986.

CHAPTER 390

(Senate Bill 945)
AN ACT concerning

Baltimore City - Alcoholic Beverages

FOR the purpose of altering the amount of capital investment

necessary as a requirement for restaurants to qualify for a
certain alcoholic beverages license in Baltimore City;
including Baltimore City in a certain provision of law that
allows a person of a certain age or older to be employed to
sell, serve, deliver, or otherwise deal with alcoholic
beverages; increasing the fine that the Baltimore City board

of license commissioners may charge a licensee for

violations of alcoholic beverages laws affecting Baltimore
City; and providing for the applicability of the Act.

BY repealing and reenacting, with amendments,

Article 2B - Alcoholic Beverages

Section 41(b-3A) , and 117(e)7, and 203(a-2)
