(g) An (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS

SUBSECTION, AN action under this subtitle shall be filed within
three years after :

(1) {the] THE death of the injured person; OR.

(2) THE DATE THE DEPENDENTS OF THE INJURED PERSON
KNEW OR REASONABLY SHOULD HAVE KNOWN OF THE WRONGFUL ACT,
WHICHEVER DATE IS LATER.

(2) (I) IN THIS PARAGRAPH "OCCUPATIONAL DISEASE"

MEANS A DISEASE CAUSED BY EXPOSURE TO ANY TOXIC SUBSTANCE IN THE

PERSON'S WORKPLACE AND CONTRACTED BY A PERSON IN THE COURSE OF
THE PERSON'S EMPLOYMENT.

(II) IF AN OCCUPATIONAL DISEASE WAS A CAUSE OF
A PERSON'S DEATH, AN ACTION SHALL BE FILED WITHIN 3 YEARS OF THE
DISCOVERY OF FACTS FROM WHICH IT WAS KNOWN OR REASONABLY SHOULD
HAVE BEEN KNOWN THAT THE OCCUPATIONAL DISEASE WAS A CAUSE OF
DEATH

1. WITHIN 5 YEARS OF THE TIME OF DEATH OR

2. WITHIN 3 YEARS OF THE DATE WHEN THE
CAUSE OF DEATH WAS DISCOVERED, WHICHEVER IS THE SHORTER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.

AN ACT concerning

Creation of a State Debt - Martin's Creek - Flood Control Project

FOR the purpose of authorizing the creation of a State Debt in

the amount of $200,000, the proceeds to be used as a grant
to the Mayor and Council of the City of Brunswick for the
purpose of the planning, design, construction, and equipping
of the Martin's Creek Flood Control Project in the City of
Brunswick in Frederick County, including the construction of
parking and parking access areas in connection with the

flood control projects, subject to the requirement that the
Mayor and Council of the City of Brunswick provide at least
an equal and matching fund of a certain kind for the same
