CHAPTER 369

(Senate Bill 829)

AN ACT concerning

Drivers' Licenses - Alcohol Restriction

FOR the purpose of authorizing the Motor Vehicle Administration

in certain instances to impose on a licensee an alcohol
restriction which prohibits the licensee from driving or
attempting to drive a vehicle while having any alcohol in
his body; providing that the Motor Vehicle Administration
shall record a certain court order on a certain driver's
license and driving record, and shall keep other records of
the court order; prohibiting a licensee who is restricted by
a court or the Administration from driving or attempting to
drive a vehicle while having any alcohol in his body, from

doing so and providing a certain penalty blood; authorizing
a police officer to arrest without a warrant a person whom

the officer has probable cause to believe has committed a

violation of a certain alcohol restriction; authorizing the

Administration to conduct chemical tests for persons with

alcohol restrictions under certain conditions; providing an

exception to the Administration's authority to modify a

suspension or issue a restricted license; providing for

certain criminal trials procedures in certain prosecutions
under certain circumstances; providing that it is prima
facie evidence that a defendant has alcohol in the
defendant's body if testing determines a blood alcohol level
above a certain level; and generally relating to alcohol
restrictions on drivers' licenses.

BY repealing and reenacting, with amendments,
