SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That the Laws of Maryland read as follows:

Article 73B - Pensions
159.

(11) (A) In addition to hearings required under the

provisions of the Administrative Procedure Act, the Board of
Trustees may hold hearings when deemed necessary in the
performance of its duty. The hearings shall be governed by rules
and regulations of the Board and the Board shall not be bound by
technical rules of evidence.

(B) IN THE EVENT ANY APPLICATION FOR DISABILITY
RETIREMENT ON BEHALF OF A STATE POLICE OFFICER UNDER ARTICLE 88B,
SECTION 15(B)(16) IS APPROVED BY THE BOARD OF TRUSTEES FOR
MARYLAND STATE RETIREMENT AND PENSION SYSTEMS, THE HEARING SHALL
BE HELD UNLESS WAIVED IN WRITING BY THE OFFICER BEING RETIRED.

Article 88B - State Police

15.

(b) In supervising and directing the affairs of the
Department and in exercising the powers referred to in the
preceding subsection, the authority of the Superintendent shall
include, but shall not be limited to, the powers:
