AN ACT concerning

Personal Medical Records - Disclosure -
Organ and Tissue Procurement

FOR the purpose of permitting the disclosure to and examination
of the medical records of a potential organ and tissue donor
by certain organ and tissue procurement personnel under
certain conditions; providing for the consent of the
physician for the potential organ and tissue donor; and
generally relating to the disclosure of medical records of a
potential organ and tissue donor to organ and tissue
procurement personnel.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

4-301.

(a)  Any provider of medical care who has custody of medical
records may reveal specific medical information contained in
those records:

(1)  To the individual on whom the record is kept or
the individual's agent or representative; or

(2)  As authorized in Article 48A, Subtitle 20 of the
Code.

(b)  Any provider of medical care who has custody of medical
records may not reveal specific medical information contained in
those records to any person unless authorized by the individual
on whom the record is kept.

(c)  Subsection (b) of this section does not apply to a
provider of medical care who has custody of medical records if
the provider is:

(1) Performing medical services or allied support
services for or on behalf of a patient;
