   259                           Novembr. Court 1717
   vizt. Cepi Corpus pr S:Wilmer Sherf .   .    And A Declaration —
   being filed when Said writ Issued forth and a Copy thereof—
   Served therewith According to Act of Assembly in Such Case made
   which was as folls vizt. Kent County Ss : George Gleaves Junr. of Kent
   County Planter Stands attached to Answer unto William Smith of a Plea of
   Trespass upon the Case
   And whereupon the aforesd William by Thomas Bowne his Attorney Complains
   for that whereas the aforesd William in the year of our Lord Christ one thousand
   Seven hundred and Seventeen and untill this time was att St Pauls Parish
   in Kent County att Sd Parish within the Jurisdiction of this Court an Approved
   Innholder and Ordinary keeper and as Such Sold vended and delivered to
   diverse Inhabitants of this Province and other persons diverse liquors and
   found and provided other Suitable Accommodations dureing which Said
   time of the Said Williams So keeping an Inn or Ordinary viz ye twenty first
   day of August in the year of our Lord Christ Seventeen hundred & Seventeen
   att St Pauls Parish in Kent County aforesd within the Jurisdiction of—
   this Court In Consideration that the Said William att the Speciall Instance
   and request of the aforesd George had then and there last mentioned Sold and
   delivered to the aforesd George to the proper use and behoofe of ye aforesd
   George diverse liquors in an Account hereto Annexed mentioned att ye
   Severall rates and prices in the Said Account Sett forth in the whole——
   amounting unto the Summ of Six hundred and Seventy eight pounds of
   Merchantable Tobacco and the Said George upon himself Assumed and to
   the Said William then and there last mentioned faithfully promised that
   he the Said George the aforesd Six hundred and Seventy eight pounds of
   Merchantable Tobacco to the Said William when thereunto required, would
   well and truly pay and Content   And that whereas also ye aforesd George
   afterwards vizt the aforesd twenty first day of August in the year—.
   aforesd att the Parish County and Jurisdiction aforesd in Consideration
   that the aforesd William att the like Speciall Instnace and Request of the
   aforesd George had then and there last mentioned Sold and delivered to the
   aforesd George to the proper Use and behoofe of the aforesd George diverse
   liquors in An Account hereto Annexed Specifically Sett forth upon—
   himself Assumed and to the Said William then and there last mentioned
   faithfully promised that he the Said George So much Merchantable
   Tobacco at the aforesd last mentioned liquors Sold and delivered as aforesd
   were att the time of the Sale and delivery thereof att reasonable rates and
   prices worth and amounted to unto the Said William when thereunto
   he the Said George Should be required would well and truly pay and
   Content. And the aforesd William Indeed Say’th that ye aforesd last mentioned
   liquors Sold and delivered as aforesd att the time of the Sale and delivery thereof
   att reasonable rates and prices were worth and amounted to the Summ of
   Six hundred and Seventy eight pounds of Merchantable Tobacco in ye
   manner as in the last Said Account Sett forth of which the Said George then
   and there last mentioned had Notice:   Nevertheless the aforesd George his
   Severall promises and Assumptions aforesd in form aforesd l made litle
   minding but fraudulently Intending him the Said William in that behalf
   to deceive and defraud the aforesd Severall Summs of Tobacco in the whole
   amounting to the Summ of thirteen hundred and fifty Six pounds of
   Merchantable Tobacco to the Said William hath not paid Altho’
   afterwards vizt: the aforesd twenty first day of August in ye year aforesd
   att the parish aforesd in the County and Jurisdiction aforesd he ye Said
   George was by the Said William thereunto required the aforesd thirteen
   hundred and fifty Six pounds of Tobacco hath not paid nor made Content
