    173                                    March Court 1716
   for the Same and Cost thereon accrueing Therefore it is Considered by
   the Court here vizt. the Same day last mentioned That the afd Plaintifs Richard
   Smithers and Mary his wife Executrix of the last will and testament of John
   Carvill deceased Recover against the Said Defendant Benjamin——
   Griffith as well The afd Sumes of one Thousand pounds of Tobacco and
   ffour hundred and forty pounds of Tobacco the debts afd as also the Sume
   of Three hundred and Sixty one pounds of Tobacco Cost by the afd Plts —
   about their Suites in this behalf expended and by the Court here of their
   assent adjudged and the Said Deft~ in mercy &ca

Richard Smithers and Mary his wife late
   Called Mary Carvill Execrx. of ye last will & Testament of John Carvill late of Sd.
   County Gent~ deceased of a plea that he render to them the full and Just Sum
   of one Thousand two hundred pounds of Tobacco of ye value of five pounds-
   Sterling money which he unjustly detains &ca. And whereupon the afd
   Richard and Mary by Thomas Bowne their attorney Say that whereas
   the afd Benjamin the fourteenth day of Ffebruary Anno Domini Seventeen
   hundred & eight in the life time of the Said John at S.t Pauls Parish in Kent
   County afd within the Jurisdiciõn of this Court by his certain writing obligatory
   which ye Said Benjamin Sealed with his Seale & as his deed delivered hereinto
   Court brought the date whereof is the Same day & year afd granted himselfe to
   owe and be Indebted to the afd John in his life time the afd full and Just~
   Sume of one Thousand two hundred pounds of Tobacco of the afd value of
   five pounds Sterling money to be paid to the Said John in his life time or
   to his Executors when thereunto required Yet the afd Benjamin altho’ often
   required the afd one Thousand two hundred pounds of Tobacco to the afd
   John in his life time or to the afd Mary while Sole after the death of the
   Said John or to the Said Richard and Mary after Espousals between—
   them Celebrated hath not rendered but that to the Said John in his life
   time and to the Said Mary while Sole after the death of the Said -
   John and to the Said Richard and Mary after Espousals afd to —
   Render hitherto hath denied and to the Said Richard And Mary
