Ch. 11

Assembly may wish to consider specifically the
following provisions.

It is unclear whether the second clause of former §
28A(a)(4) was intended to act as a limitation on the
records to be kept. The former clause refers to the
types of records "which may be required of the private
health or social welfare organizations or individuals
as a condition of receiving State funds". However,
there is no substantive requirement to keep any
records as a condition of receiving State funds.

The General Assembly also may wish to consider the

inconsistent use of the words "private" and

"voluntary" to modify the references to "health or
social welfare organization[s]".

The General Assembly also may wish to consider
comparing the mandatory recordkeeping requirement for
a Maryland resident or organization under former Art.
19, § 28A(c)(l) with the discretionary recordkeeping
requirement for a nonresident or an organization that
is not incorporated in this State as provided in
former § 28A(c)(2). It is unclear on what factors the
General Assembly intended to base these recordkeeping
requirements.

Finally, the General Assembly also may wish to
consider whether former § 28A(d), now revised as
subsection (e) of this section, adds anything to the
requirement that financial records be kept in
accordance with uniform accounting standards as
provided under former § 28A(b)(l) and (c)(1) and (2),
now revised as subsections (c)(2) and (3) and (d) of
this section.

7-404. REVIEW OF ACCOUNT OF PROVIDERS OF CARE.

(A)  DEFINITIONS.

(1)  IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)  "DEPARTMENT" MEANS A PRINCIPAL DEPARTMENT OF THE
EXECUTIVE BRANCH OF THE STATE GOVERNMENT.

(3)  "INDEPENDENT UNIT" MEANS A UNIT OF THE STATE
GOVERNMENT THAT IS NOT IN A DEPARTMENT.

(B)  SCOPE OF SECTION.

THIS SECTION DOES NOT APPLY TO:

(1) A PRIVATE PROVIDER WHO PROVIDES CARE FOR 4 OR
FEWER INDIVIDUALS;
