(III) THE REASONS FOR THE APPROVAL.

(C) CONTINUATION.

THE APPROVAL OF A NEW POSITION UNDER THIS SECTION IS
TEMPORARY. HOWEVER, UNLESS THE GENERAL ASSEMBLY DELETES THE
POSITION FROM THE BUDGET BILL, THE POSITION CONTINUES WITH THE
COMPENSATION PROVIDED IN THE STATE BUDGET.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
former Art. 78A, § 16B(a).

Subsection (b) of this section is new language derived
without substantive change from former Art. 41, §
71(b-l).

Subsection (c) of this section is new language derived
without substantive change from the first and fifth
sentences of former Art. 78A, § 16B(b).

In subsection (c) of this section, the former
statement that deletion of a position from the budget
bill "negate[s]" the Board's approval as of the first
day of the next fiscal year is deleted, to avoid the
suggestion that legislative action is retroactive and
also to reflect that the Governor may elect to omit
the position from the next budget bill.

The second and third sentences of former Art. 78A, §
16B(b), which required the "approval of a new ...
position" to be included in the report under former
Art. 41, § 71(b-l) and specified the time for
submitting the report, are deleted as unnecessary in
light of the more detailed provision of the formerly
referenced subsection -- now subsection (b) of this
section.

The fourth sentence of former Art. 78A, § 16B(b),
which provided that inaction by the General Assembly
is approval, is deleted as surplusage.

7-237. CONTRACTS.

(A) SCOPE OF SECTION.

THIS SECTION APPLIES TO ANY OFFICER OR AGENT OF THE STATE
WHO IS CHARGED WITH:

(1) CONSTRUCTION, IMPROVEMENT, OR MAINTENANCE OF A
BUILDING OR WORK; OR

(2) MANAGEMENT OF OR PROVISION FOR A STATE
INSTITUTION.
