7-104. PREPARATION OF DRAFT OF PROPOSED BUDGET.

(A)  GENERAL DUTY.

(1)  THE SECRETARY SHALL PREPARE FOR THE GOVERNOR A
DRAFT OF THE PROPOSED BUDGET.

(2)  THE DRAFT SHALL:

(I)  BE COMPREHENSIVE;

(II)  ELIMINATE DUPLICATION AND CONFLICT; AND

(III)  INCLUDE EACH ITEM THAT THE GOVERNOR IS
REQUIRED BY LAW TO INCLUDE IN A PROPOSED BUDGET.

(B)  CAPITAL IMPROVEMENTS.

THE SECRETARY SHALL INCLUDE IN THE DRAFT ITEMS FOR CAPITAL
IMPROVEMENTS THAT WILL NOT BE INCLUDED IN THE CONSOLIDATED LOAN
BUDGET.

(C)  ANCILLARY POWERS.

THE SECRETARY MAY SPECIFY:

(1). THE FORM TO BE USED BY A UNIT OF THE EXECUTIVE
BRANCH OF THE STATE GOVERNMENT OR A PRIVATE ENTITY TO REQUEST AN
APPROPRIATION FROM THE STATE;

(2)  INFORMATION THAT MUST BE SUBMITTED WITH THE FORM;
AND

(3)  THE TIME FOR SUBMISSION OF THE FORM.

REVISOR'S NOTE: Subsections (a)(1) and (2)(i) and (ii),
(b), and (c) of this section are new language derived
without substantive change from former Art. 15A, § 19,
§ 21(b) and the first sentence of (a), and the third
clause of the first sentence of § 17.

Subsection (a)(2)(iii) of this section is new language
added to avoid repetition of former references such as
"[i]n the preparation and submission of the budget
bill ..., the Secretary and the Governor shall ...".

In subsection (a)(1) of this section, the word "draft"
is substituted for the former word "tentative", for
clarity.
