clause of Art. 88C, § 4(a)(1).

It is set forth in a separate section for emphasis.

The only changes are in style.

The balance of former Art. 88C, § 4(a)(1) is deleted
as redundant of § 5-808 of this subtitle.

Defined term: "Department" § 5-101

5-803. MEMBERSHIP.

(A)  COMPOSITION; APPOINTMENT OF MEMBERS.

(1)  THE COMMISSION CONSISTS OF THE FOLLOWING 13
MEMBERS:

(I)  A SENATOR APPOINTED BY THE PRESIDENT OF THE
SENATE;

(II)  A MEMBER OF THE HOUSE OF DELEGATES
APPOINTED BY THE SPEAKER OF THE HOUSE; AND

(III)  11 MEMBERS APPOINTED BY THE GOVERNOR.

(2)  A MEMBER APPOINTED BY THE GOVERNOR MAY NOT HOLD A
SALARIED STATE OFFICE.

(3)  AS FAR AS POSSIBLE, MEMBERS APPOINTED BY THE
GOVERNOR SHALL BE SELECTED TO REFLECT DIFFERENT BROAD GEOGRAPHIC,
ECONOMIC, AND SOCIAL INTERESTS IN THE STATE.

(B)  TENURE; VACANCIES.

(1)  A MEMBER APPOINTED BY THE PRESIDENT OF THE SENATE
OR THE SPEAKER OF THE HOUSE SERVES AT THE PLEASURE OF THE
APPOINTING AUTHORITY.

(2) (I) THE TERM OF A MEMBER APPOINTED BY THE
GOVERNOR IS 4 YEARS AND BEGINS ON JUNE 1 IN THE YEAR IN WHICH THE
MEMBER IS APPOINTED.

(II)  AT THE END OF A TERM, A MEMBER APPOINTED
BY THE GOVERNOR CONTINUES TO SERVE UNTIL A SUCCESSOR IS APPOINTED
AND QUALIFIES.

(III)  A MEMBER WHO IS APPOINTED BY THE GOVERNOR
AFTER A TERM HAS BEGUN SERVES ONLY FOR THE REST OF THE TERM AND
UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
former Art. 88C, § 4(a)(2) and (5).
