Ch. 11

In subsections (c), (d), and   (e) of this section, the

words "political subdivision"   are substituted for the

former references to a "local subdivision" or
"subdivision", for clarity.

In subsection (c) of this section, the word "affected"
is added for consistency with language used elsewhere
in this section.

In subsection (d) of this section, the word
"regulations" is substituted for the more general
former word "guidelines", for clarity and to conform
to the actual practice of the Department, which has
interpreted this section as permitting the Secretary
to adopt regulations. See COMAR 16.04.01, which cites
this section as authority for the Department to adopt
regulations concerning areas of critical State
concern.

Also in subsection (d) of this section, the word
"Secretary" is substituted for the former word
"Department" to conform with § 5-105(b) of this title,
which authorizes the Secretary to adopt regulations
for the Department.

5-612. LAND USE RECOMMENDATIONS.

THE PLAN SHALL CONTAIN RECOMMENDATIONS FOR THE MOST
DESIRABLE GENERAL PATTERN OF LAND USE IN THE STATE. THE
RECOMMENDATIONS SHALL BE BASED ON THE BEST AVAILABLE INFORMATION
CONCERNING:

(1)  ENVIRONMENTAL AND NATURAL FACTORS, INCLUDING
CLIMATE, SOIL AND UNDERGROUND CONDITIONS, TOPOGRAPHY, AND WATER
SOURCES AND BODIES OF WATER;

(2)  PRESENT AND PROSPECTIVE ECONOMIC BASES OF THE
STATE;

(3)  WATER AND SEWERAGE FACILITIES;

(4)  TRENDS OF INDUSTRIAL, POPULATION, OR OTHER
DEVELOPMENTS;

(5)  HABITS AND STANDARDS OF LIFE OF THE PEOPLE OF THE
STATE; AND

(6) THE RELATION OF LAND USE IN THE STATE TO LAND USE
IN ADJOINING AREAS.
