5-404. CONTRIBUTION AND REIMBURSEMENT FOR ASSISTANCE.

(A)  TECHNICAL ASSISTANCE UNDER § 5-402 OR § 5-403(A).

THE DEPARTMENT MAY COLLECT REIMBURSEMENT, IN ACCORDANCE WITH
AN AGREEMENT, FOR TECHNICAL SERVICES THE DEPARTMENT PROVIDES
UNDER § 5-402 OR § 5-403(A) OF THIS SUBTITLE.

(B)  OTHER ASSISTANCE UNDER § 5-403.

EXCEPT AS OTHERWISE PROVIDED IN SUBSECTION (A) OF THIS
SECTION, THE DEPARTMENT MAY REQUIRE A CONTRIBUTION IN ANY AMOUNT
FROM A LOCAL GOVERNMENT OR REGIONAL PLANNING AGENCY THAT REQUESTS
ASSISTANCE UNDER § 5-403 OF THIS SUBTITLE.

(C)  CONTRIBUTIONS REQUIRED BY FEDERAL LAW.

IF FEDERAL LAW REQUIRES A CONTRIBUTION IN ANY AMOUNT AS A
CONDITION BEFORE A LOCAL GOVERNMENT OR A REGIONAL PLANNING AGENCY
MAY RECEIVE FINANCIAL OR OTHER PLANNING ASSISTANCE, THE
DEPARTMENT MAY SUPPLY ALL OR PART OF THE CONTRIBUTION, UNLESS THE
FEDERAL LAW SPECIFIES THAT THE LOCAL GOVERNMENT OR REGIONAL
PLANNING AGENCY SHALL MAKE THE CONTRIBUTION.

REVISOR'S NOTE: This section is new language derived
without substantive change from the third sentence of
former Art. 88C, § 2(i) and the third sentence and the
first clause of the second sentence of § 8.

In subsection (b) of this section, the words "local
government or regional planning agency" are
substituted for the former word "agency", for clarity
and to conform to apparent legislative intent.

In subsection (c) of this section, the words "local
government or regional planning agency" are
substituted for the former word "locality", for
clarity and to conform to apparent legislative intent.
