Subsections (c) and (d) of this section are new
language derived without substantive change from
former Art. 78A, §§ 22(7) and 24(c) and the first
sentence of (b).

In subsection (b)(1) of this section, the former
reference to January 1, 1978, is deleted as obsolete.

In subsection (d) of this section, the phrase "under
the jurisdiction" is substituted for the former phrase
"subject to the control" to conform to similar
provisions in this subtitle.

The only other changes are in style.

The third sentence and the second clause of the second
sentence of former Art. 78A, § 24(b), which related to
the preparation of the policies and standards
described in this subsection before January 1, 1978,
are deleted as obsolete.

4-408. REPORT ON PUBLIC IMPROVEMENTS.

(A)  IN GENERAL.

ON OR BEFORE MAY 31 OF EACH YEAR, EACH UNIT OF THE STATE
GOVERNMENT SHALL SEND A REPORT ON THE CONDITION OF EACH PUBLIC
IMPROVEMENT UNDER ITS JURISDICTION TO:

(1)  THE DEPARTMENT OF BUDGET AND FISCAL PLANNING;

(2)  THE DEPARTMENT OF GENERAL SERVICES; AND

(3)  THE DEPARTMENT OF STATE PLANNING.

(B)  CONTENT OF REPORT.
THE REPORT SHALL:

(1)  IDENTIFY THE PUBLIC IMPROVEMENT; AND

(2)  STATE WHETHER THE PUBLIC IMPROVEMENT IS BEING
MAINTAINED IN ACCORDANCE WITH THE POLICIES AND STANDARDS
ESTABLISHED BY THE DEPARTMENT OF GENERAL SERVICES.

(C)  RECOMMENDATIONS.

WITH THE ASSISTANCE OF THE DEPARTMENT OF BUDGET AND FISCAL
PLANNING AND THE DEPARTMENT OF STATE PLANNING, THE DEPARTMENT OF
GENERAL SERVICES SHALL RECOMMEND MEASURES NECESSARY TO CORRECT
DEFICIENCIES IN THE MAINTENANCE AND REPAIR PROGRAMS.
