STANDARDS.
(A) IN GENERAL.
THE BOARD OF PUBLIC WORKS, THROUGH THE DEPARTMENT OF GENERAL
SERVICES, SHALL PUBLISH MINIMUM STANDARDS FOR FACILITIES FOR
HANDICAPPED INDIVIDUALS IN PUBLIC BUILDINGS. THE STANDARDS
SHALL CONFORM TO AMERICAN STANDARDS ASSOCIATION SPECIFICATION
A 117.1-1961, AS MODIFIED BY THE DEPARTMENT OF GENERAL SERVICES.
(B) APPLICATION OF STANDARDS.
THE STANDARDS MAY NOT REQUIRE FACILITIES FOR HANDICAPPED
INDIVIDUALS IN ANY PART OF A PUBLIC BUILDING THAT IS NOT OPEN TO
OR USED BY THE GENERAL WORKING FORCE OR THE GENERAL PUBLIC.
(C) COMPLIANCE.
THE APPROPRIATE CONTRACTING AUTHORITY SHALL DETERMINE
WHETHER THE PLANS AND SPECIFICATIONS FOR ANY PUBLIC BUILDING
BUILT BY THE STATE, A POLITICAL SUBDIVISION OF THE STATE, OR A
PUBLIC AUTHORITY MEET THE STANDARDS ADOPTED UNDER THIS SECTION.
(D) FILING.
THE STANDARDS SHALL BE FILED WITH THE SECRETARY OF STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 78A, §
51(e), (f), and the first and second sentences of (d).
In subsection (a) of this section, the reference to
the Department of General Services is substituted for
the former reference to the Department of Public
Improvements to conform to former Art. 41, § 231D,
which abolished the Department of Public Improvements
and transferred the former duties of the Department of
Public Improvements to the Department of General
Services.
Also in subsection (a) of this section, the former
reference to July 1, 1968, is deleted as obsolete.
Also in subsection (a) of this section, the former
reference to the Department of General Services
modifying the standards "in cooperation with
Governor's Study Group on Vocational Rehabilitation"
is deleted as obsolete since the Governor's Study
