REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 78A, §
54(d).

In the introductory language of subsection (b) of this
section, the word "presently", which formerly modified
"inadequate", is deleted as surplusage.

In subsection (c) of this section, "publicly owned" is
substituted for the former word "public", for
consistency with the language used in subsections (a)
and (b) of this section.

In subsection (d)(1) of this section, the phrase
"provide the information to the appropriate local
jurisdictions" is substituted for the former phrase
"provide the appropriate information to local
jurisdictions", for clarity and to conform to
administrative practice.

GENERAL REVISOR'S NOTE:

The Commission to Revise the Annotated Code points out to
the General Assembly that, throughout this subtitle, the word
"facility" is substituted for the former references to "building
or facility" because the word "facility" encompasses any
"building".

SUBTITLE 5. FACILITIES FOR HANDICAPPED.

2-501. DEFINITIONS.

(A)  IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the first phrase of
the first, sentence of former Art. 78A, § 51(b).

(B)  FACILITY FOR HANDICAPPED INDIVIDUALS.

"FACILITY FOR HANDICAPPED INDIVIDUALS" INCLUDES ANY DOOR,
ELEVATOR, HANDRAIL, RAMP, SPECIALLY TREATED SURFACE, OR SIMILAR
DESIGN, CONVENIENCE, OR DEVICE THAT FACILITATES THE HEALTH,
SAFETY, OR COMFORT OF A HANDICAPPED INDIVIDUAL.

REVISOR'S NOTE: This subsection formerly appeared as the
third sentence of Art. 78A, § 51(b).

In this subsection, and in subsection (c) of this
section, the word "individual" is substituted for the
former word "person", for clarity.
