2-402. STATE TO PAY COSTS.

(A)  ANNUAL OPERATING COSTS; LATERAL SYSTEM CONSTRUCTION
COSTS.

THE STATE SHALL PAY ITS SHARE OF:

(1)  THE ANNUAL OPERATING COSTS OF FURNISHING WATER
AND SEWER SERVICE TO ANY STATE FACILITY; AND

(2)  THE LATERAL SYSTEM CONSTRUCTION COSTS ASSOCIATED
WITH THE INSTALLATION OF ANY WATER OR SEWER LINE THAT DIRECTLY
SERVES THE STATE FACILITY.

(B)  EXPANSION COST.

THE STATE SHALL PAY THE COST OF EXPANDING A WATER OR SEWAGE
TREATMENT FACILITY IF THE EXPANSION IS NECESSITATED BY THE USE OF
THE FACILITY BY THE STATE. HOWEVER, THE AMOUNT THE STATE PAYS
MAY NOT EXCEED THE COST OF THE CAPACITY REQUIRED BY THE STATE.

subsection (a)(1) and (2) of this section, see General

In subsection (b) of this section, the words "capacity
required" are substituted for the former words "actual

2-403. STATE TO PAY ASSESSMENTS, CHARGES, AND FEES.

THE STATE SHALL PAY ANY ASSESSMENT, CHARGE, OR FEE THAT IS:

(1)  LEVIED BY THE LOCAL JURISDICTION IN WHICH THE
STATE FACILITY IS LOCATED; AND

(2)  DESIGNATED AS THE STATE'S SHARE OF ANNUAL
OPERATING COSTS OR LATERAL SYSTEM CONSTRUCTION COSTS.
