2-305. PROHIBITED ACTS; PENALTIES.

(A)  PROHIBITED ACTS.

A PERSON MAY NOT USE, WITH INTENT TO DEFRAUD, ON A PUBLIC
SECURITY OR AN INSTRUMENT OF PAYMENT:

(1)  A FACSIMILE SIGNATURE, OR ANY REPRODUCTION OF IT,
OF ANY AUTHORIZED OFFICER; OR

(2)  A FACSIMILE SEAL, OR ANY REPRODUCTION OF IT, OF
THE STATE OR OF ANY OF ITS POLITICAL SUBDIVISIONS.

(B)  PENALTIES.

A PERSON WHO VIOLATES ANY PROVISION OF THIS SECTION IS
GUILTY OF A FELONY AND ON CONVICTION IS SUBJECT TO A FINE NOT
EXCEEDING $5,000 OR IMPRISONMENT NOT EXCEEDING 10 YEARS OR BOTH.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 31, § 16.

In subsection (b) of this section, the phrase "on
conviction is subject to" is substituted for the
former phrase "shall be punishable by" as standard
language used throughout the revised articles in a
penalty section.

2-306. SHORT TITLE.
