In subsection (c)(1)(ii) of this section, the
reference to the "Department of Budget and Fiscal
Planning" is substituted for the former word
"Department", although the immediate antecedent was
"Department of Fiscal Services". This substitution
conforms to practice.

2-205. SURPLUS FOOD.

THE GOVERNOR MAY DESIGNATE ANY UNIT OF THE STATE GOVERNMENT:

(1)  TO ACCEPT ANY SURPLUS FOOD THAT, UNDER AN ACT OF
CONGRESS, IS AVAILABLE TO THE STATE; AND

(2)  TO MANAGE AND DISPOSE OF THE FOOD IN ACCORDANCE
WITH FEDERAL LAW.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, § 81.

In the introductory language of this section, the
former phrase "as may, in his discretion, seem
advisable" is deleted as unnecessary in light of the
discretion inherent in the phrase "may designate".

(B)  AUTHORIZED OFFICER.

"AUTHORIZED OFFICER" MEANS ANY OFFICIAL OF THE STATE OR ANY
OF ITS POLITICAL SUBDIVISIONS WHOSE SIGNATURE TO A PUBLIC
SECURITY OR INSTRUMENT OF PAYMENT IS REQUIRED OR PERMITTED.
