This section is revised to refer to submission of and
action on a "proposal", to standardize the former
references to a "State determination", "such
determination", "proposal[s]", and "matter".
Therefore, former Art. 15A, § 15A(c), which defined
"State determination", is set forth in subsection
(c)(2) of this section as a substantive provision on
the scope of this section.
In subsection (c)(2)(i) of this section, the former
words "implement, or administer" are deleted as
unnecessary in light of the broad word "participate".
Subsection (f) of this section is revised to state
that, after the specified period expires, the Governor
may act regardless of whether the Legislative Policy
Committee has acted.
In subsection (f) of this section, the power to "act
on the proposal" is substituted for the former power
to "proceed to make the State determination", which
suggested that the action of the Governor would be to
adopt the proposal.
The second sentence of former Art. 15A, § 15B(b)(l),
which required that the proposal "be submitted at
least 60 days prior to the date of determination [or
the] lesser time period" that the Legislative Policy
Committee sets, is deleted as unnecessary in light of
subsection (f) of this section, which does not require
the Governor to predict a date for action on the
proposal or to anticipate a waiver of the 60-day
period.
As to the power of the General Assembly to accept
grants, see Md. Constitution, Art. III, § 46. See
also SG § 2-407(b)(7), under which the Legislative
Policy Committee may accept grants while the General
Assembly is not in session.
2-203. NOTICES ON FEDERAL AID.
(A) REGULATIONS.
AFTER CONSULTATION WITH THE DEPARTMENT OF BUDGET AND FISCAL
PLANNING, THE SECRETARY OF STATE PLANNING SHALL ADOPT REGULATIONS
THAT REQUIRE A UNIT OF THE STATE GOVERNMENT TO SUBMIT
INFORMATION, AS REQUIRED IN THIS SECTION, ON FEDERAL AID,
INCLUDING GRANTS, INSTRUCTIONAL CONTRACTS, LOANS, RESEARCH
CONTRACTS, OR OTHER ASSISTANCE.
(B) INSTRUCTIONAL AND RESEARCH AID.
(1) EACH 6 MONTHS, A UNIT SHALL SUBMIT A SUMMARY
